That's right, I think (the "hardware" is patent protected).

But you cannot get the rights on the name "Ondes Martenot" 
without the agreement of the family of Maurice Martenot ;
the name is protected by the french "Droit d'Auteur" -
but you are free to produce sounds sounding like
Ondes Martenot (even with a sewing machine ;-)
